General Terms & Conditions

General Information, Scope
These General Terms and Conditions ("GTC") apply to all services offered by SkiCarvingHub by Kili Weibel Coaching (hereinafter referred to as "SCH"), regardless of whether the contract is concluded online, in writing, or verbally.
These GTC become binding upon booking any service provided by SCH. The person making the booking ("Customer") also accepts these GTC on behalf of all accompanying participants ("Participants") and confirms that they have informed all participants accordingly.
Conditions of Participation
Customers and participants agree to follow all instructions given by the assigned coach or guide throughout the activity.
Unless otherwise agreed, participants are responsible for bringing suitable ski equipment, clothing, protective gear, and any other required personal equipment.
Participation requires good physical health and an appropriate fitness level. Customers must inform SCH in writing before the activity of any illness, injury, pregnancy, medical condition, or other circumstance that could affect participation.
Participation under the influence of alcohol, drugs, medication affecting performance or judgement, or other intoxicating substances is strictly prohibited.
SCH reserves the right to inspect equipment and refuse or terminate participation if safety requirements are not met. No refund will be granted in such cases.
Conclusion of Contract
For online bookings, the contract becomes legally binding upon completion of the booking process.
For bookings made by email, telephone, WhatsApp or any other communication channel, the contract becomes effective upon written confirmation by SCH.
The booking confirmation defines the agreed services, dates, prices and payment conditions.
Scope of Services
The booked service includes only those services explicitly stated in the booking confirmation or published offer.
Unless otherwise specified:

Lift tickets are not included.

Equipment rental is not included.

Accommodation, meals and transportation are not included.
Group camps require the published minimum number of participants.
SCH reserves the right to assign coaches according to availability and operational requirements.
Prices and Payment Terms
The prices published at the time of booking apply.
SCH reserves the right to adjust prices without prior notice for future bookings.
Unless otherwise agreed, full payment must be received before the first day of the booked service.
Failure to pay by the agreed deadline may be considered a cancellation by the customer and cancellation fees may apply.
SCH reserves the right to request a deposit or payment guarantee for certain bookings.
Cancellation by the Customer
The following cancellation policy applies:
Private Coaching & Guiding

More than 72 hours before the activity: free cancellation

Less than 72 hours before the activity: 100% of the booked service
Ski Camps & Multi-Day Programs
Unless otherwise stated in the specific camp information:

More than 30 days before arrival: free cancellation
-
30–15 days before arrival: 50% of the total amount
-
Less than 15 days before arrival: 100% of the total amount
Late arrival, early departure or exclusion from the activity due to violation of these GTC does not entitle the customer to any refund.
SCH recommends purchasing appropriate travel and cancellation insurance.
Cancellation or Changes by SkiCarvingHub
SCH generally operates regardless of weather conditions.
SCH reserves the right to cancel, postpone or modify services in the following situations:

unsafe weather, snow or mountain conditions;

force majeure or circumstances beyond SCH's control;
-
insufficient number of participants for group activities;
-
illness, accident or unforeseen unavailability of a coach;
-
safety concerns affecting participants or coaches.
Where possible, SCH will offer:

an alternative date,
-
a comparable replacement service, or
-
a refund for the unused service.
No further compensation shall be payable.
Prevented by Accident or Illness
If participation becomes impossible due to accident or illness before or during the booked service, refunds are granted only upon presentation of an official medical certificate.
Approved refunds are generally issued as a credit voucher valid for future bookings with SCH unless otherwise agreed.
Insurance/liability
Participation in all activities is entirely at the participant's own risk.
SCH accepts no liability for accidents, injuries, loss, theft or damage to equipment or personal belongings unless caused intentionally or through gross negligence.
SCH shall not be liable for indirect or consequential damages.
Participants are responsible for maintaining adequate accident, health, rescue and personal liability insurance.
Data Protection / Image Material
SCH processes personal data in accordance with applicable Swiss data protection legislation.
Photos and videos taken during coaching sessions, camps or events may be used by SCH for marketing, social media, website and promotional purposes.
Participants may object to such use at any time by notifying SCH in writing before or after the activity
Applicable law, place of jurisdiction
These GTC are governed exclusively by Swiss law.
The exclusive place of jurisdiction shall be Engelberg (OW), Switzerland.
